Ahatova, Yurieva Yaroshenko and disqualified for 2 years

The decision has finally been adopted, but it is not in our favor! The independent Anti-Doping Commission IBU convicted Catherine Yuryev, Albin Ahatovu and Dmitry Yaroshenko in applying rEPO and suspended from the start for 2 years (3-5 December 2008). The independent Anti-Doping Commission of SMEs, which in January 2009 is an independent body responsible HCMs to hear people and decision-making on anti-doping, acknowledged the decision of the Russian Biathlon 11.08.2009 Catherine Yuryev, Albin Ahatovu and Dmitry Yaroshenko guilty of violation of Article 1.2.2 of anti-doping Regulation HCMs (ADP) in its version of September 2008 ( "Presence of a prohibited substance"). This body, whose members are international experts on anti-doping in the medical and legal fields, made the following decisions:

1. Kateryna Yurieva due to the detection of prohibited substances excluded from participation in competitions HCMs for two years. The ban started on 04.12.2008. Samples taken in the testing program HCMs 04.12.2008 and 05.12.2008 to contain a prohibited substance rEPO, it was found that WADA accredited laboratory. Thus, Mrs. Yurieva violated Art. 1.2.2 ADP in its version of September 2008

2. Mrs. Albina Ahatova due to the detection of prohibited substances excluded from participation in competitions HCMs for two years. The ban started on 05.12.2008. Samples taken in the testing program HCMs 05.12.2008, contained a prohibited substance rEPO, it was found that WADA accredited laboratory. Thus, Mrs. Ahatova violated Art. 1.2.2 ADP in its version of September 2008

3. Mr. Dmitry Yaroshenko due to the detection of prohibited substances rEPO also be suspended from participation in competitions HCMs for two years. The ban started on 03.12.2008. Samples taken from Mr. HCMs Yaroshenko 03.12.2008, 05.12.2008 and 06.01.2009 in the testing program HCMs contain a prohibited substance rEPO, it was found that WADA accredited laboratory. In so doing, Mr. Yaroshenko violated Art. 1.2.2 ADP in its version of September 2008 HCMs may appeal against the decision pursuant to Articles 8.1.8 and 13.2.3 (c) ADP revised in 2009

Athletes have the right to appeal against the decision of the arbitral tribunal under Articles 8.1.8 HCMs and 13 ADP HCMs as amended in 2009, or alternatively in accordance with Article 13.2.1 ADP 2009 appeal directly to CAS, with the consent of both of the SME as well as from athletes. In any case, the appeal must be filed within 21 days after receipt of this decision.
